These terms govern your use of Octi8, a calorie and macro tracking service operated by S.Ruttloff, Computer Hard- & Software. They describe what the service includes, what customers may expect from us, and what we expect from users in return.
1. Scope and acceptance
These terms apply to access to and use of the Octi8 website, trial registrations, customer accounts, and related support communication. By registering, starting a trial, or using the service, you agree to these terms and to the privacy policy.
2. Service description
Octi8 is a web-based calorie and macro diary designed for daily nutrition logging on mobile and desktop. Features may include food search, barcode lookup, recipe support, diary tools, charts, sharing functions, import and export, and related account settings.
- Octi8 is intended as an information and tracking tool, not as medical treatment or diagnosis.
- Certain features may evolve, be improved, or be removed if required for product quality, security, legal compliance, or technical operations.
3. Registration and customer accounts
To create an account, users must provide complete and accurate information, including name, country, email address, and a password. Account credentials must be kept confidential.
- You are responsible for activity carried out through your account unless misuse was caused by our fault.
- You must notify us without undue delay if you suspect unauthorized access to your account.
- We may reject registrations or suspend accounts where the submitted information is clearly false, abusive, or unlawful.
4. Trial period, pricing, and paid use
New customers may receive a free 30-day trial starting on the registration date. After the trial, continued access may require a paid plan according to the pricing shown on the website.
- The current standard plan is 29.99 Euro per year unless a different offer is shown at the time of purchase.
- Taxes, invoicing details, and payment processing are determined by the checkout or billing flow used for the purchase.
- If no paid extension is completed after the trial, we may limit or deactivate access to the service.
5. Acceptable use
You may use Octi8 only for lawful purposes and in a way that does not harm the service, other users, or third parties.
- Do not attempt unauthorized access, security testing without permission, or interference with the availability or integrity of the service.
- Do not upload or share unlawful, infringing, malicious, deceptive, or abusive content.
- Do not misuse automated systems in a way that creates unreasonable load or bypasses intended product limits.
6. User data, food entries, and shared content
You retain responsibility for the content you enter into Octi8, including foods, recipes, notes, and shared items. You confirm that you have the necessary rights to any content you upload or share.
- You grant us the limited rights required to host, store, process, display, and transmit your content solely to operate and improve the service for you.
- If you use sharing features, you are responsible for deciding what is shared and with whom.
- We may remove content that is unlawful, technically harmful, or clearly inconsistent with these terms.
7. Availability, maintenance, and changes
We aim to keep Octi8 available and secure, but uninterrupted availability cannot be guaranteed. Maintenance, updates, provider outages, and technical faults may temporarily affect access.
- We may modify interfaces, features, or integrations when reasonably necessary for security, stability, compliance, or product development.
- Where practical, material customer-facing changes will be communicated in an appropriate form on the website or inside the service.
8. Health-related disclaimer
Octi8 provides nutritional tracking information for general information purposes only. It does not replace medical advice, diagnosis, or treatment.
- You should seek qualified professional advice before making significant health, diet, medication, or treatment decisions.
- Imported food data, barcode results, and user-generated entries may contain errors and should be reviewed by the user.
9. Suspension and termination
You may stop using Octi8 at any time. We may suspend or terminate access if required by law, for security reasons, for non-payment, or for a material breach of these terms.
- Where reasonable, we will try to provide prior notice before termination that is not caused by urgent security or legal reasons.
- Termination does not affect claims that already arose before the termination date.
10. Warranty and liability
Statutory rights remain unaffected. To the extent permitted by law, Octi8 is provided without guarantees of uninterrupted availability, absolute accuracy, or fitness for a specific user outcome.
- We are fully liable for intent, gross negligence, injury to life, body, or health, and where mandatory law requires it.
- For slight negligence, we are liable only for breach of essential contractual obligations and limited to foreseeable typical damage.
- We are not liable for user-entered errors, third-party data-source inaccuracies, or decisions taken solely on the basis of logged nutrition data.
Mandatory consumer rights and mandatory statutory liability rules remain unaffected.
11. Applicable law and contact
German law applies, excluding conflict-of-law rules, unless mandatory consumer protection law in your country of residence provides stronger protection. The provider of Octi8 is S.Ruttloff, Computer Hard- & Software, Owner: Sven Ruttloff, Morgensternstr.15, 04179 Leipzig, Germany.
